Terms of service

Welcome to TruckCompliant. These terms of service ("terms") are a legal agreement between you and Understand My Policy, Inc., a Delaware corporation, doing business as TruckCompliant ("we," "us," "our"), which operates the service at truckcompliant.com (the "service"). By using the service, you agree to these terms. If you do not agree, do not use the service.
1. What TruckCompliant is (and is not)
TruckCompliant is a software tool. It reads publicly available carrier records and, where you provide them, documents you upload, to explain your compliance obligations in plain English, organize your records, track deadlines, and link you to the free official government portals where filings are made.
We never file. We do not submit forms to any agency, do not log into government accounts on your behalf, and do not process filing payments. The final submit button is always yours, on an official .gov site.
TruckCompliant is not a law firm, a compliance consultant, a process agent, an insurance broker, or a government agency. We are not affiliated with, endorsed by, or sponsored by FMCSA, USDOT, UCR, or any state agency. We do not provide legal advice. Nothing in the service, including checklists, statuses, due dates, and citations, is legal advice. If you want legal advice or representation, consult a licensed attorney in your jurisdiction.
2. No guarantee of outcomes
Compliance determinations, audits, and enforcement actions are decided by government agencies, not by us. We make no promise or guarantee that using the service will result in passing a new entrant safety audit, avoiding a violation, maintaining operating authority, or achieving any particular safety rating or CSA score. Following a checklist in the service is not a defense to an enforcement action.
3. Deadlines are your responsibility
Filing deadlines are set by federal and state agencies and can change. While the service displays deadline information and can send reminder emails, you are solely responsible for knowing and meeting the deadlines that apply to your operation. We are not liable for any missed deadline, revoked authority, out-of-service order, or penalty, including if a reminder email is delayed, filtered, or not delivered, or if displayed deadline information is inaccurate or outdated.
4. Data sources and accuracy
The service relies on public records, including FMCSA's SAFER, Licensing and Insurance, and census systems, state records, and information and documents you provide. Government records can contain errors, and there is often a lag between a change in your operation and its appearance in the official record. We display the date FMCSA last reported the data we show. We work to keep data current but provide it "as is" and do not warrant that any record, status, checklist item, citation, or due date is accurate, complete, or current. Always verify against the official sources we link to.
Regulations change. Citations shown in the service reference the rules as we understand them at the time of display and may not reflect recent amendments, exemptions, or state-specific variations that apply to you.
5. Government fees and free filings
We show government fees separately from any charge by us, and we tell you when a filing is free. Fees change without notice and the amounts we display may be out of date. You can always complete any filing yourself, directly with the agency, without paying us anything. Our subscription fees buy explanation, organization, tracking, and reminders. They do not buy filing services, and no portion of what you pay us is a government fee.
6. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the service. Some features require an account. You represent that you own, operate, or are authorized to act for the carriers you add to your account. You are responsible for the accuracy of the information you provide, for maintaining the security of your account credentials, and for all activity under your account. We may suspend or terminate accounts that violate these terms.
7. Purchases, subscriptions, and cancellation
Paid features are offered at the prices and on the terms displayed at checkout. Payments are processed by our payment provider; we do not store your full card details.
Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel before renewal. You can cancel at any time from your account in one click. Cancellation stops future renewals; it does not retroactively refund the current period except as described in our refund policy displayed at checkout or on the pricing page.
Refunds are governed by the refund policy displayed at the time of purchase, if any. Otherwise, all purchases are final and non-refundable except where required by law.
8. Acceptable use
You agree not to: use the service for any unlawful purpose; scrape, bulk-download, or systematically extract data from the service; resell or redistribute the service or its outputs except as expressly permitted; use the service to generate leads or contact lists for compliance, insurance, or factoring solicitation; interfere with or disrupt the service; attempt to access accounts or data that are not yours; represent to anyone that TruckCompliant is a government service or is affiliated with FMCSA or USDOT; or use the service to harass others or invade anyone's privacy.
9. Your content
You retain ownership of documents and information you upload. You grant us a limited license to process them in order to provide the service, including using third-party processing providers (for example, for document text extraction and analysis). We do not use your uploaded documents to market to third parties.
You are responsible for maintaining your own copies of records required by federal or state rules. The service is an organizational tool, not a system of record, and you should not rely on it as your sole copy of any document required for an audit or inspection.
10. Our intellectual property
The service, including its software, design, text, checklist methodology, and templates, is owned by us or our licensors and is protected by law. Materials generated for you are yours to use for your own operation. You may not copy, modify, or create derivative works of the service itself, or use our branding without permission.
11. Third-party services
The service depends on third-party providers, including payment processing, authentication, hosting, email delivery, analytics, and document analysis. We are not responsible for outages or errors in third-party services, and your use of those services may be subject to their own terms. Links to government portals and other outside sites are provided for convenience; we do not control them and are not responsible for their content, availability, or fees.
12. Disclaimer of warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, downtime, revoked or suspended operating authority, out-of-service orders, fines, penalties, failed audits, or increased insurance costs, arising out of or related to the service. To the maximum extent permitted by law, our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the three months before the claim arose or one hundred dollars. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these terms, your violation of applicable law or regulation, or your misuse of the service.
15. Termination
You can stop using the service and delete your account at any time. We may suspend or terminate your access if you violate these terms or if we discontinue the service, and where required we will provide a pro rata refund of prepaid, unused subscription fees. You are responsible for exporting your documents before terminating.
16. Changes to the service and these terms
We may modify the service and these terms. If we make material changes to these terms, we will post the updated terms with a new effective date and, where appropriate, notify account holders by email. Continued use of the service after changes take effect constitutes acceptance.
17. Governing law and disputes
These terms are governed by the laws of the state of Florida, without regard to conflict of law rules. Any dispute arising from these terms or the service will be resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction. Either party may seek relief in small claims court for qualifying disputes.
18. General terms
These terms, together with the privacy policy and any terms presented at checkout, are the entire agreement between you and us regarding the service. If any provision of these terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
